Welcome to True Tattoos (the “Website”), owned and operated by True Tattoos LLC (“Company,” “we,” “us,” or “our”). By accessing or using our Website, directory, and services, you (“User,” “Artist,” “Studio,” or “Visitor”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, do not use the Website.

 

1. Purpose of the Service

True Tattoos LLC provides an online, interactive directory and informational platform (“Service”) that showcases local tattoo artists and studios.

 

2. Directory Listings & The “Claiming” Process

Placeholder Profiles: Company may create introductory, unclaimed directory profiles for legally licensed tattoo studios and artists using publicly available information (such as state licensing databases and public social media accounts). These listings are intended strictly for informational and navigational purposes.

    • Claiming a Listing: An artist or studio may request to take ownership of a placeholder profile through our designated “Claim Listing” verification process.
    • Verification and Approval: Company reserves the right, in its sole discretion, to approve or deny any claim request. By claiming a listing, you represent and warrant that you are the individual artist or an authorized representative of the studio named in the profile.
    • Transfer of Ownership: Upon approval of a claim, control of the listing will be transferred to the registered user account. The claiming party assumes full responsibility for all content, links, and updates made to that profile moving forward.

 

3. Subscriptions, Fees, and the 90-Day Free Trial

    • The 90-Day Free Trial: Approved claimed profiles may receive access to a “Professional” features package for a promotional period of ninety (90) days starting from the date the claim is approved (“Trial Period”). No subscription fees are charged during this Trial Period.
    • Transition to Paid Account: Following the expiration of the Trial Period, continued access to Professional Tier features (including but not limited to expanded profile information and gallery display abilities, verified badge, and advanced metrics) will require a paid subscription. Current subscription rates and terms will be clearly outlined on the website’s checkout pages.
    • No Obligation: There is no obligation to convert to a paid subscription after the Trial Period. If you choose not to upgrade, your profile may revert to a standard, non-professional listing tier.
    • Taxes: All paid membership and subscription fees are subject to applicable state and local sales tax. In accordance with Texas tax regulations, sales tax will be calculated and collected based on the taxable classification of digital information and directory services.

 

4. User-Generated Content & Intellectual Property

    • Ownership of Portfolio Content: Artists retain all intellectual property rights to the photographs, artwork, descriptions, and portfolios they upload or link to their profiles.
    • License to Company: By uploading, posting, or linking content to the Website, you grant True Tattoos LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, distribute, and display such content solely for the purpose of operating, marketing, and promoting the directory and the True Tattoos platform.
    • Content Restrictions: You agree not to upload any content that:
      • Infringes upon the intellectual property or copyright of any third party.
      • Is defamatory, obscene, pornographic, vulgar, or promotes illegal activity.
      • Contains malicious code, viruses, or tracking scripts.
    • Right to Remove: Company reserves the right to remove or edit any listing, text, or image at any time without prior notice if it is deemed to violate these Terms or harm the integrity of the platform.

 

5. Copyright Infringement (DMCA Policy)

If you believe that any content on True Tattoos infringes upon your copyright, please submit a formal takedown request to our designated agent at hello@true-tattoos.com containing the physical or electronic signature of the copyright owner, identification of the infringed work, and direct links to the material on our site.

 

6. Third-Party Links and Services

Our Website utilizes payment infrastructure provided by Stripe and framework integrations via WooCommerce. By interacting with our paid tiers or setting up account checkouts, you agree to comply with Stripe’s and WooCommerce’s respective terms of service. Company is not responsible for any payment disruptions, errors, or security breaches occurring on third-party payment gateways.

 

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TRUE TATTOOS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY MAKES NO WARRANTY THAT THE DIRECTORY WILL MEET YOUR EXPECTATIONS, INCREASE YOUR BUSINESS/BOOKINGS, OR REMAIN COMPLETELY UNINTERRUPTED OR ERROR-FREE.

 

8. Limitation of Liability

TO the MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUE TATTOOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES (WHETHER INCURRED DIRECTLY OR INDIRECTLY), OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

 

    • YOUR USE OF OR INABILITY TO USE THE SERVICE.
    • THE BEHAVIOR, CONTENT, OR TATTOO SERVICES PROVIDED BY ANY ARTIST OR STUDIO LISTED IN THE DIRECTORY.
    • ANY DISPUTES, INJURIES, SANITATION ISSUES, OR CONTRACTUAL FAILURES ARISING BETWEEN A DIRECTORY VISITOR (CLIENT) AND A DIRECTORY LISTING (ARTIST/STUDIO).

 

9. Indemnification

You agree to defend, indemnify, and hold harmless True Tattoos LLC, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of the site, your violation of these Terms, or your violation of any third-party rights or local health regulations.

 

10. Governing Law & Jurisdiction

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Use of the Website shall be instituted exclusively in the state or federal courts located in Dallas County, Texas, and you expressly consent to the personal jurisdiction of such courts.

 

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect by posting a notice prominently on the Website or via email to registered users. What constitutes a material change will be determined at our sole discretion.
